Deportation Defense

For lawful permanent residents, a person must have been in the United States for the past seven years and must have been a lawful permanent resident for at least five years. In addition, the lawful permanent resident must show proof of a hardship if deportation were to occur. The person must disclose any prior crimes to the attorney during the initial consultation because a criminal record could affect the process.
For those with no immigration status, a person must show ten years of continuous presence in the United States. In addition, this person must show proof of a hardship to a U.S. citizen family member such as a spouse or a child. It is very important to tell the attorney about any past crimes because a criminal record could affect the cancellation of removal process.
In the Northwest, there are two Immigration Court locations. In Oregon, the Immigration Court is located in Portland. In Washington, the Immigration Court is located in Seattle. It is often possible to transfer a case from Seattle to Portland if the client lives in Oregon.
